The following general „Terms and Conditions” of www.ARTONERY.com contains regulation about co-operation between Customer and ARTONERY company.
Customer who intends to purchase from ARTONERY should read these „Terms and Conditions” carefully before ordering any goods from our website. By purchasing any of the products Customer agrees to be bound by these conditions. We store the contract’s content and we can modify and update information in this „Terms and Conditions” document due to changes in legislation. Customer should check this regulation regularly to make sure he is aware of any changes made. This regulation is in force from February 2015.

§ 1. GENERAL INFORMATION


ARTONERY is a website owned by company Arton Magdalena Drewnicka Latała registered in Poland with address at 31-426 Krakow, Generała Prądzyńskiego 8 street with tax identification number PL6761014415. All inquiries and claims should be sent to the sales@artoney.com e-mail address or you may call us on +48 784 084 378 | mobile: +48 535 079 302. The telephones are open to receive calls on Monday to Friday between 8 am and 4:30 pm.

ARTONERY specializes in sales of toners & spare parts to copiers and printers to many well known brands. Sales of genuine and compatible consumables is performed on territory of EU countries and we can also ship the consignment to the farthest corners of the world. Arton was estabilished in 1991. We supply toners, developers, drums, rollers and also spare parts like bearings, gears, clutches etc. genuine as well as compatible version. We want ensure our Customers foolproof and full-scale choice of consumables. Information included on-line about product’s availability is not a base to treat as contents of our shop but it is only kind on invitation for cooperation with our company.

Any information content on our website is protected by copyright law. Users can not use information contained on ARTONERY website without our permission, can not use it for any illegal purpose or activity, may not copy and distribute it or in general reproduce in any manner. ARTONERY contains trademarks, logos and brand names which are the property of their respective holders and have been used only for information purposes.
Further in this document „Terms and Conditions” the owner of e-shop ARTONERY which is ARTON Magdalena Drewnicka Latała will be replaced by ARTONERY shortcut.

§ 2. FAIR INFORMATION PRACTICES & COOKIES POLICY


Customer who creates an account on ARTONERY is required to read these „Terms and Conditions”carefully before ordering goods. By ordering any products he agrees and accepts all clauses of this regulation and implies agreement for processing by ARTONERY any personal details such as name, surname, address, e-mail address, mobile etc., (according with Polish Law of Personal Data Protection). This information is collected only for particular legal activities of our company. Customer’s e-mail address should be used mainly to send order confirmation, for order update or to answer on his e-mail inquiries.
Password which Customer receives during registration in ARTONERY or during modification of personal information can’t be shared with another person. Password’s name should be unique and known only by customer who bears the risk of sharing of his own password.

A cookie is a small text file that we store on your device if you agree. Our website uses cookies to distinguish you from other users of our website. § 3. PRICES


ARTONERY uses information about product prices on the website www.ARTONERY.com. Product’s prices are given on-line in euro as 2 prices: net price (without VAT) and also as gross price (with VAT - price in bold) and concern single products (pcs., bot.) or products in package (pkg., set, ). Prices don’t include cost of shipping.
All prices on our invoice are in euro and include VAT tax – with the current 23% VAT Polish rate. In the case of a transaction with a foreign country being a EU member to achieve a 0% rate on the invoice, Customer is required to send us European VAT Identification Number – then we’ll check it and assign suitable prices. Customers which are not EU members can get net price but before confirming net price with 0% rate we need Company Statement Document (document which is quoted for all taxation purposes where have you full company name and address is stated) and Certificate of Company Registration. We work with retail clients and we also offer product for further resale for wholesale customer.

Price is valid only for products chich are available while ordering. In case product is out of stock ARTONERY has the right to change price which is sattled according to availability and loading time offered by our supplier.

Products with status “Price subject to change” have only initial information and the price should be confirmed after customer’s inquiry. This product is ordered for Customer after his written order. Final price is the one after customer’s conformation and acceptance. If the price happens to change Customer should confirm the price that is offered to him by e-mail or by phone after the order. ARTONERY has the right to add and to remove without any prior notice some products from our trade offer or to modify prices and availability of the products.

ARTONERY offers promotional products with “SUPER PRICE”. These products could have broken packaging or package in old design. Those products are 100% new products and haven’t been used, they also have 2 months guarantee from purchasing date. SUPER PRICE products could be in another compatible versions of another manufacturer e.g. from one product’s family Ricoh, NRG, Infotec, Lanier, Savin according to current stock level.

§ 4. SALE’S RULES


Customer makes purchase of goods via ARTONERY e-shop. After correctly completed Registration Form in our e-shop, Customer receives access to retail prices. Business wholesale Customer who further re-sales consumables, can receives access to wholesale prices when documents that confirm wholesale cooperation are send to ARTONERY by e-mail or fax. After verification we change price profile in ARTONERY. Registration in ARTONERY is free and is not to binding for Customer.

§ 5. ORDER REALIZATION



§ 5.1. Add products to cart
Primary condition of purchases in ARTONERY e-shop is correctly completed Registration Form. When Customer decides to order product one should use button “add to cart” which is part of description of each product on-line.

§ 5.2. Place the order
Purchase in our e-shop can be performed only by persons with at least 18 years old. Orders can be submitted 24 hours per day. We process / send orders from Monday to Friday up to 14:30. After adding products to cart Customer should end ordering process by clicking button “view cart” and click accepting „Therms and Conditions” and filling out all necessary data in respective steps.

§ 5.3. Order specification
All orders performed on-line are sent to Customer via e-mail as “Order Specification”. We confirm by e-mail complete info with price, date or estimated delivery time. Customer can make changes in the order until status is changed. All accepted information are confirmed by e-mail which we send to Customer while the status is changed.

§ 5.4. Order cancellation
Customer can cancel the order when ordered products are currently on our stock and only in situation when order hasn’t been sent by forwarder or if the product is not available anymore. Resignation from order is respected only by written way via e-mail.

§ 5.5. Status of order
Implementation of order starts when order status is changed and Customer receives information about new order’s status. ARTONERY uses following statuses to inform Customer about order phase: Cancel; Pending; Processing; Completed.

ARTONERY has the right not to realizm the order when ordered product is permanently not available or is obsolete. In case of order for goods that are available for order – Customer receives information about estimated loading time. Customer should make decision:
- sending ordered goods partly,
- sending ordered goods completely,
- cancel whole order.
Customer has 5 working days to make decision regarding order processing. After 5 days without Customer answer ARTONERY cancels order. We are entitled to make partial deliveries if this is deemed reasonable for the Customer.


§ 5.6. Products „on special order”
Products „on special order” are strictly ordered for special Customer request. Availability and price for those products is individually consulted with the Customer in case of any discrepancy from the one specified on the website. For goods on special order a prepayment may be charge and in some cases Customer has to wait for these ordered goods for a longer time than usually. ARTONERY may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by Customer.

§ 5.7. Realization of outsized orders
Rules of realization outsized orders are individually consulted with Customer. In valid situations ARTONERY reserves the right to refuse order realization and to require pre-payment for ordered products. ARTONERY has also the right to stop the supply of missing ordered products if Customer fails to execute payment.

§ 5.8. Invoice
All purchases are confirm by invoice which is usually send as attachment in e-mail confirmation and are also attached to the parcel (with label „invoice”). All prices on our invoice are in euro and include VAT tax – with the current Polish VAT 23 % rate or alternatively are granted with 0% rate in cases where appreciate.

§ 6. PAYMENTS METHODS


For foreign customers beeing EU members ARTONERY offers following payment methods:

§ 6. 1. Cash – pick up in the office. In office Customer can pay by Cash Or payment card. Ex work Krakow
The customer can arrange pick-up for ordered goods only for shipping within the EU countries and if the price on the invoice include 23% tax rate. In the case of 0% tax on invoice - shipping only by ARTONERY's forwarders.

§ 6.2. Prepayment
Prepayment should be performed on the following bank account:
Arton Magdalena Drewnicka Latala ALIOR BANK SA; IBAN: PL23 2490 0005 0000 4600 2768 9341; SWIFT / BRE CODE: ALBPPLPW.

Goods can be sent only when we receive payment confirmation from our bank account. Customer has 5 days to make pre-payment. After this time ARTONERY has the right to cancel order and not to continue further order realization.

§ 6.3. PayPal on-line payment
In case of PayPal payment Customer has the right to cancel the order but additional 5% discount is not valid while choosing this payment metod. ARTONERY may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by Customer.

§ 7. DELIVERY


Products ordered from Monday to Friday until 14:30 can be sent in the same day but only when products are available on stock and payment is cleared on our bank account or is performed by PayPal.
We offer fast DHL and DPD delivery. We deliver goods within Poland to listed EU countries and we can also ship the consignment to the farthest corners of the world. The cost of delivery to EU countries is listed below. Worldwide is quoted with individual prices.

§ 7.1. Parcel dimensions
The listed shipping costs are valid for shipment consisting of 1 parcel up to 30 kg, dimensions: 60 cm / 50 cm / 50 cm and sum of circuit and the longest side can’t be bigger than 3 meters. We deliver in above mentioned packaging. Any special packaging requested by Customer is subject to additional charges.

§ 7.2. Shipping cost on invoice
ARTONERY places shipping cost on invoice.

§ 7.3. Contact with forwarder
After sending parcel Customer receives e-mail information about shipping with tracking number. Status of the parcel can be checked on DHL or DPD website.

§ 8. RECEIVE OF GOODS


When Customer receives shipping from forwarder, he is obliged to check carefully his parcel to estimate if the products have not been damaged during shipping. When the company tapes are damaged Customer should not accept parcel from forwarder and has to complete claim protocol. If it happens that Customer discovers product defect after forwarder already left – Customer is obligated to contact immediatelly with the courier and write claim protocol describing details. Contact details regarding forwarder can be fund on DHL, DPD, UPS international websites.

§ 9. RULES OF RETURN


The customer is kindly ask to send back the good/s on his own expense and to make sure that the returned item/s are secured in a manner that the value of the product/s will not be diminished in any way.

§ 9. 1. Product return without reason
Right to cancel:
Customer has the right to cancel contract within 14 days without giving any reason. The cancellation period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last good.
To exercise the right to cancel, Customer must inform us (ARTONERY / ARTON MAGDALENA DREWNICKA LATAŁA, Prądzyńskiego 8, 31-426 Krakow, Poland, sales@ARTONERY.com ) of his decision to cancel this contract by a clear statement (e.g. a letter sent by post, fax or e-mail). Customer may use the attached model cancellation form but it is not obligatory. To meet the cancellation deadline, it is sufficient for Customer to send his communication concerning his exercise of the right of cancel before the cancellation period has expired.

Effects of cancellation:
If Customer cancel this contract, we will reimburse to Customer all payments received from him, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about his decision to withdraw from this contract. We will make the reimbursement using the same means of payment as you used for the initial transaction, unless Customer has expressly agreed otherwise; in any event, he will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or he has supplied evidence of having sent back the goods, whichever is the earliest.
Customer shall send back the goods or hand them over to us, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if he send back the goods before the period of 14 days has expired. Customer will have to bear the direct cost of returning the goods. Customer is only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Above details are included in the attached model cancellation form. Customer is kindly requested to add to every return filled Complaint / Return Form Customer’s bank account number.

ARTONERY is not responsibile for shipping failure because of incorrect delivery address. In this case Customer pays shipping cost again.


§ 9. 2. Returns because of damages in the shipping
Every complaints is consider based on previous agrement with ARTONERY representative. Customer can’t send back product without previous agreeing with ARTONERY. Customer can refuse to accept parcel because of damaged packaging. Refusal to accept or return is possibile in case when Customer has written claim protocol signed with courier (protocol will be submitted by courier). In complaint protocol complete information should be considered regarding parcel condition. Protocol should be given to courier immediately with date of receipt.
Based on claim protocol all complaints are considered. Processing time is considered with time of complaints in shipper, usually up to 3 months. After this process Customer receives invoice credit note if appropriate. ARTONERY may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by Customer.

§ 9. 3. Returns because of “warranty for defects”
ARTONERY is responsible to the Customer if the product sold has: defect which decrease value of usefulness of the product or in case when purchased product hasn't properties, which have been included in products description and Customer didn't know about it. Basis for complaint because of „warranty for defects” is completed form which is kindly requested to be sent to ARTONERY with control prints confirming defects. Customer has no right to complaint because of defects if he knew about defect during purchase. ARTONERY gives warranty for defects within 2 months from purchase. ARTONERY may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by Customer.

§ 10. COMPLAINT


To avoid misunderstanding in ARTONERY all product complaints are kindly request to be agreed via e-mail sales@artonery.com prior to return.

§ 10.1. Complaint rules
Basis for complaint because of warranty for defects is: completed form sent to ARTONERY with control prints confirming product defects (description about defect should be included on form in heading called „description of the cause of the complaint. Customer is kindly ask to send form by e-mail on sales@artonery.com. After ARTONERY receives complaint form Customer will receive confirmation of complaint beginning. Then Customer can send back resepective products. All complained products should be packed carefully, safely and properly (not ony loose in box). Customer is also kindly requested to put on box label „complaint” and send goods in original box. Customer can make complaint because above causes up to 2 months from goos purchase date. Complaints will be considered approx. within 14 days after receiving goods but may be extend for reason beyond our control.

§ 10.2. PCU i Imaging Units products Complaints
Special case of complaint is PCU and drum units return. In this case claims can only be accepted for maximum of remaining operating life but no higher than 75 % of the original operating life. All of those complaints must have attached print copies and parameter list.

§ 10.3. Realization of complaints
Complaint will be considered approx. within 14 days after receiving goods but ARTONERY should do all the obligations under the complaint. If the whole procedure is preserved complaint process is began. Reported complaint receives identification number. Processing time can be changed independently of ARTONERY, if the goods have been delivered without complete documentation. If complaint is justified (products defect is without Customer fault) ARTONERY will pay back cost of purchased goods on customer's bank account. The relevant cost is returned after credit note is signed.

§ 11. FINAL REGULATIONS


Buyer’s and seller’s rights and obligations are regulated only by decision included in this „Terms and Conditions”. Customer should know and accept information and decisions included in this document before purchase. Customer’s use of this e-shop and his order, implies his agreement and acceptance of clauses of this „Terms and Conditions”. ARTONERY makes its best effort to deliver reliable and proven product’s description and information on its website. ARTONERY isn’t responsible for any changes settled by product’s manufacture and isn’t responsible for any possible errors / mistakes that May occassionally occure in product’s descriptions.
All brand names and trademarks used on our website are the property of their respective holders and have been used only for information purposes.
We also inform that ARTONERY reserves the right to: - realize big orders in individual separate parts; - remove without any prior notice some products from our trade offer; - modify prices and availability of products during the day and periodically; - add new products to its offer; - manage, change and cancel promotion campaigns; - modify and update information in hereby „Terms and Conditions”. Customer can contact with ARTONERY in the event of any questions or inquiries. We always try to find the best solution for our customers.

When Customer submits an order on the website he agrees to be subject to current „Terms and Conditions” at the date one submits the order. Customer is responsible for reviewing the latest „Terms and Conditions” each time he submitting the order.
These „Terms and Conditions” and contract (and all non-contractual obligations arising out of or connected to them) shall be governed and construed in accordance with Polish law. Customer submits to the exclusive jurisdiction of the Polish courts to settle any dispute which may arise under these terms of use. ARTONERY has the right to amend these „Terms and Conditions” at any time. All changes to these „Terms and Conditions” will be posted on-line. By using the website Customer indicates that he accept these rules of use and agrees by the „Terms and Conditions”.

§ 12. PRIVACY POLICY


ARTONERY is owned by company Arton Magdalena Drewnicka Latała, with registered address at 31-426 Krakow, Generała Prądzyńskiego 8 street with tax identification number PL6761014415. Data protection is a matter of trust and customer privacy is important to us. Various data that we collect, store and process are necessary for during Customers purchase and for further processing e.g. payment, shipment, claims, returns etc. ARTONERY may collect name, surname, gender, e-mail address, postal and delivery address, phone number, mobile number, fax number, payment details, payment card details or bank account details. ARTONERY may use the information to administer Customer account, verify and carry out financial transactions. Contracting parties are obligate to keep secret information about rules of this contract. E-mail address and personal data can also be used for marketing purposes if Customer subscribed to newsletter. You can unsubscribe from our newsletter at any time. Customer undertakes not to transmit to another person any extra technical information which was obtained from ARTONERY (according with Polish law from 16.04.1993 about protection against unfair competition). It is not necessary to accept cookies during visit on ARTONERY website but when Customer places an order he should set his browser to accept cookies.
