REGULATIONS OF www.ARTONERY.com
This regulations is about co-operation between Customer and www.ARTONERY.com company.Customer, who intends purchase from ARTONERY.com, should create an account in www.ARTONERY.com and also should know and accept information and decisions, included in this statute.
ARTONERY e-shop reserves the right to modify and update information in this regulations, due to changes in legislation. Customer needs to check this regulation regularly to enshure he is aware of any changes made. This regulation is effective from April 2010.
§ 1. GENERAL INVORMATION
www.ARTONERY.com website is owned by trading company Arton Magdalena Drewnicka Latała, with registered office in Cracow, Generała Prądzyńskiego 8 street, 31-426 Crakow; mobil. 012 410 55 11, fax. 012 410 55 10, with tax identification number: PL6761014415.
ARTONERY e-shop users may send any request or claims to the following e-mail address: sales@artoney.com.
www.ARTONERY.com operates the safe internet shopping is e-shop specializes in toners & spare parts to copiers and printers to various brands. Sales of genuine and compatible consumables is performed on territory of EU countries.
Arton estabilished in 1991. We supply toners, developers, drums, rollers and also spare parts like: bearings, gears, clutches etc. original and also alternative. We want ensure our Customers foolproof and full-scale choice of consumables.
Information included in our e-shop about product’s available, are not base to treat contents of our shop as offer which about talk statute book, nut are only invitation to entering into agreement with us.
Any information and content contained in our website are protected, what ansues from copyright law. Therefore ARTONERY.com user commits not use it for any illegal purpose or activity, may not copy and distribute and or in general reproduce in any manner information contained in our website without our permit.
Our e-shop may contain trademarks, logos and designs - all brand names and trademarks are the property of their respective holders and have been used only for information purposes.
In this regulations, owner of ARTONERY e-shop – Arton Magdalena Drewnicka Latała and www.ARTONERY.com are shortcut called ARTONERY.
§ 2. FAIR INFORMATION PRACTICES
Customer who makes an account in our e-shop, implies his agreement and acceptance of clauses of this regulation and for collect and transform by ARTONERY any personal details such as his name, address, e-mail address, mobile etc., (according with polish Law on Protection of Personal Data). This information are collected only for particular legal activities of our company.
According to polish law from 18.07.2002. which is effective from 10.03.2003, polishOfficial Gazette number 144, pos. 1204 - Dz. U. nr 144, poz. 1204) about electronic services, acceptance of this regulation is also agreement for e-mail receive any commercial information, news and events in our company. We ensure that this information will be send casual. Customer’s e-mail address should be use mainly to send confirmation and update of his order or to answer for his e-mail questions.
We also inform that password which customer gives during registration in our e-shop or during modification of personal information, can’t be share to another persons. Password’s name should be unique, and known only by customer, who bears the risk of sharing of his own password.
§ 3. PRICES
ARTONERY insert price’s information about offered products on his website www.ARTONERY.com.
Product’s prices are given in euro as price without VAT and also with VAT and concern single products (pcs., bot.) and products in package (pkg., set, ). Prices in our e-shop don’t include cost of shipping. We work with retail client and we also offer product for further resale for wholesale domestic and foreign custmer .
During purchase is valid only price of products which is available while order. In case product is out of stock, ARTONERY reserves right to change price which is considered with available and price in our supplier.
Products which has statute “”Estimated price” is only initial information and his price should be confirm after customer’s question. This product is ordered for customer after his written order.
Final price is price after customer’s conformation and acceptance. Customer should confirm offered price by e-mail or by phone after his order. ARTONERY reserves right to add and to remove without any prior notice some products from our trade offer; modify prices and available of products periodically and during the day
Moreover ARTONERY offer promotional products with “SUPER PRICE”. Those products colud have broken package or package in old desing each manufacturer. Those products are in 100% new products and have’t been used, they also have 3 mounths guarantee from purchasing date. They could be in another compatible versions of antoher manufacturer e.g. from one product’s family Ricoh, NRG, Infotec, Lanier, Savin – is is considered with theirs availability on our stock.
§ 4. SALE’S RULES
Customer makes purchase of goods by ARTONERY.com e-shop. After correctly complement Registration Form in our e-shop, customer receive access to retail prices. Business wholesale customer who further resales consumables, can receives access to wholesale prices, when he sends us following documents:

· Regon
· NIP
· Wypełniony formularz upoważnienia do wystawiania faktur bez podpisu odbiorcy.
Customer sholud make an account in aour e-shop and send us by e-mail or fax above document. After verification we change him procing profile in ARTONERY.com.
Registration in ARTONERY.com is free and is not to bind.
Customer who sets up an account in our e-shop must accept our regulation. Personal information which customer gives during registration are necessary to correct deliver of parcel and to issue correct invoice.
Our regulation also alow some customer 7 or 14 days to make payment from the date of the invoice (this is option for regular customers, after minimum 5 only cash purchase).

§ 5. ORDER’S REALIZATION
§ 5.1. ADD PRODUCTS TO CART
Basic condition of purchaes in ARTONERY.com e-shop is correctly complement Registration Form. When customer decides to purchase a product, he should use button “add to cart” which is in description of every product in our e-shop.
§ 5.2. ORDERING
Purchase in our e-shop can make only of age persons. Shopping are available 24 hours. After adding products to cart, customer should end ordering process. He should click button “view cart”, and click acceptaion of registration, than continue process of ending order accordingly with given points.
§ 5.3. Orders confirmation
ARTONERY and customer conclude an agreement of cooperation when our employer confirm by phone or e-mail date of shipping order or reception’s possibility. Customer has right to make changes in his order but only until shipping order from our stock. After shipping parcel from our stock, order can’t be modify.
§ 5.4. Resignation from order
Customer can resign from his order only when ordered products are actually on our stock and only in situation, when order hasn’t been sent by UPS spedition. Resignation from order are respect only by written way. Customer must write to us by e-mail or fax that he resign from order, but earlier he must have our agreement. If customer resign when ARTONERY has beared the cost of purchase’s realization, customer must pay for all those costs.
§ 5.5. Status of order
During process of order’s realization of order, customer receives current tracking information. ARTONERY use following status to inform customer about status of his order: Pending; Booking / Prepaid; Ongoing; Ready to shipping; Closed, Supplied; Canceled.

ARTONERY reserves right to not realize order, when ordered product is permanently not available or because of another reasons. In case of order from which products are available for order – customer receives information howl long he must wait for product and he should make decision: - realization in part;
- wait for complete order;
- cancel all products in order.
Customer have 5 days to accordance for waiting or make decision about canselling. After 5 days without customer answer, ARTONERY cancel order.
§ 5.6. Products „on special order”
Products „on special order” we order for customer service, and available and price for those products are individually consult with the customer. ARTONERY reserves right to require 30% loan of value of all order for products which we must order and customer must wait for it for a long time. In this case if customer resing for order, this paided amount could’t be return. Products on special order could’t be complainted.
§ 5.7. Realization outsized orders
Rules of realization outsized orders are individually consult with customer. In valid situations ARTONERY reserve right to refuse realize order, to delimit payment method or to require pre-payment for ordered prodcts. After cofirmation of prices and product’s availability, further stage is consider with payment method. ARTONERY reserve also right to stop supply missing ordered products, if customer falls behind with payments (has’t paid for overdue orders). In this case, ARTONERY tell customer payment period, and after uneffective remind him, we reserve right to stop completely of realize his orders.
§ 5.8. Invoice
Each one purchase is confirm by invoice, attached to packaging. ARTONERY also places shipping cost on invoice.
§ 6. Payment methods
ARTONERY offer following payment methods:

§ 6. 2. Cash on delivery – payment on delivery.
By this method we send parcel only by UPS shipping and only if total cost isn’t higher than 5000 $ (???PRZELICZYC NA EURO). In this method we send products in the same day as order but until 15:30 and only when order is completed (all products are on stock).
§ 6.3. Prepayment for following bank account.

In this method we send parcel when we received payment on our account or when we receive confirmation of payment. Customer has 5 days to make pre-payment, after this time ARTONERY reserve right to cancel order and not to continue further realization of order.
§ 6.4. Moneybookers on line payment
ARTONERY reserve right that in case of Moneybookers payment, customer has right to rezign of order but he must pay an extra charge 3% of all cost of order (this is fee payment considers with customer payment return).
§ 7. Delivery
Products ordered form Monday to Friday to 15:30 can be sent in the same day, but only when products are available on stock. We offer fast UPS delivery. Cost of foreign delivery customer can see on attached list.
§ 7.1. Parcel dimensions
Listes rules, methods and costs obligate for shipment to 30 kg on following dimensions: 80 cm / 80 cm / 120 cm (w przypadku spedycji UPS) and sum (totality) of round and the longest site can’t be bigger than 3 meters.
§ 7.2. Parcel assurance
All domestic parcels are assurances to amount to 10000 PLN. Foreign parcels are assurance to amount 650 EURO. More than those amounts, customer must pay an extra payment 1% of all cost of order.
§ 7.3. Shipping cost on invoice
ARTONERY places shipping cost on invoice. If customer doesn’t prefer this information on invoice, he should inform us before we issue commercial invoice. Shipping cost are in force in European Union countries.
§ 7.4. Contact with messenger
After sending parcel, customer receives e-mail information about shipping with tracking number. States of the parcel can be checked on UPS website. More over, customer can contact directly with local UPS department - UPS_EUROPE_contact
§ 8. Receive of goods
When customer gest shipping from messenger, he is obliged to check careful his parcel and to estimate if the products are not damaged during shipping.
ARTONERY use solid packaging which protects from getting wet, and ours companie’s bands on packet can be proof for opened packet during shipping. In those situation customer should not take packet and he should write official document to UPS spediction and he should give it messanger immediately to fix UPS responsibility.
In moment of parcel reception, customer has all of benefits and responsibilities which are considered with purchased things and with danger with damage or loss of products (according with polish law, article 547 of Penal Code).
§ 9. RULES OF RETURN
In ARTONERY e-shop goods return can be accepted only after previous agreeing of Artonery's representative. Goods which have been order for special order (which are not available in permanent sale) can’t be return. Returns are looked into based on completed returns form, which should be submit in ARTONERY office or as attachment to returns send back goods.
§ 9. 1. Products return without reason
Return of goods can take place without giving a reason to 10 working days of the issued invoice and also under warranty for defects or damaged shipment. Returns are accepted to 10 days assuming that: - product hasn’t been used in any way and is not damaged (it concerns also original package without any added by the buyer signs and stickers, which hasn’t been unpacked, etc.); - product is complete and has orginal unpacked package with every warranty seal; - customer has proof of purchase – invoice which has been issued by Artonery, customer should add this invoice to parcel with returns goods; - customer pay for parcel with returs goods, and he is also obliged to scurely packed goods; in case of incorrect packaging of returns product, he bears the risk of damage of goods during; - customer should add to every return statement of waive the purchase contrach, with bank account number to return the amount of money;
If the aboveprocedure is maintained, ARTONERY guarantes returns of money less returns costs. ARTONERY reserves right to suspent return money transfer to expert of service, in case of doubt of returned product. ARTONERY are not responsibility for shipping failure because of incorrect delivery address. In this case customer is obligated to re-payment shipping costs. ARTONERY reserves right to not receive parcels with returns goods, which were sent as cash on delivery.
§ 9. 2. Returns becouse of damages shipping
Every complaints are respected only based on previous agreeing of Artonery's representative. Customer can’t send back complainted product without previous Artonery's agreeing (according with Article 567 § 1.Polish Civil Code). Customer can refuse to accept parcel because of damaged package or because of robbed parcel after contact with Artonery.
Refusal to accept or return is possibile lny In case when customer has written protocol with courier (protpcol sholud hale courier) with spediction which has provide. Without any complaint form, parcels which have been sent as payed by Artonery, won’t be accept and take. In complaint protocol shpuld be considered complete information about condition of parcel. Protocol should be given to courier immedietaly with date of receive. Customer immediately is obligated to send to ARTONERY above protocol. ARTONERY will receive to customer all of costs on ivoice, when shipper will consider the complaint becouse of damage shipping.
Base of complaint becouse of damage shipping is above protocol with courier. Base on this protocol all complaints are considered. Processing time is consider with time of complaints in shipper, usually to 3 mounths.
§ 9. 3. Returns becouse of “warranty for defects in”
ARTONERY are obligated to customer if product has defect, which decrase value of usefulnes of the product or in case purchased procuct hasn't properties, which have been included in products description, and custoimer didn't know about it. Customer must report this fact to 3 mounths from date of detection defect. After this time customer has no right to report this fact. Base of complaint becouse of warranty for defects in is completed form which has been sent to ARTONERY with control prints, which can confirm deffect. Customer has no right to complaint becouse of deffects if he knew about defect durring purchase.
§ 10. Complains
In our e-shop compliants of product can be akcept only after previous agreeing of return.
§ 10.1. Complaint rules
Base of complaint becouse of warranty for defects is: - completed form sent to ARTONERY with control pronts whoch confirm products defects (decription about defect must be included on form in heading called „descirption of the cause of the complaint” form should be sent by emial for sales@ARTONERY.com or by fax + 48 12 410 55 10; after receives complaint form customer will receive confirmation of complaint beggining, and then he can send back cepmplains products; without ours confirmation customer bears the risk of sending back products - all complained product must be packed carefully and safety and properly (not only feely in box) - przesyłka z odsyłanym reklamowanym produktem winna być opisana słowem „REKLAMACJA”; - reklamowany produkt zawsze musi być zwrócony w oryginalnym opakowaniu;
Customer can make complaint becouse above causes to 3 mounths from pucrhaese date (invoise date is basic). Compliant will be considered to 1 mounths.
§ 10.2. Complaints PCU i Imaging Units products
Special case of complaints is PCU and drum units return.In this case claims can only be accepted for maximum of remaining operating life but no higher than 75 % of the original operating life. All of those complaints must have attached print copies and parameter list.
§ 10.3. Implementation of complaints
Customer can make a complaint to 3 mounths from date of purchase (base is date of invoice). Complaint will be considered for 1 mounths. ARTONERY sholud do all the obligations under the complaint.
If whole procedure is preserved, complaint process is began. Reportable complaints receives identification number. Complaint will be considered for 1 mounths. Processing time can be changed independently PF Artonery. If the goods have been delivered without completed documentation and above conditions have'nt been passed , ARTONERY reserves right to stop processing time of complaint.
If complaint is justified (products defect is without customer fault) Artoner will pay back cost of purchased goods on customer's bank acoount (as it was on invoice). Cost are pay back aftre customer sign on credit note to invoice.
If complaint is unjustified (products defect is becouse of customers fault, customer must pay for sent previous complainted goods.
§ 11. Final regulations
Buyer’s and seller’s rights and obligations are ordered only by decision included in this regulations. Customer should know and accept information and decisions, included in this statute, before purchase. Customer’s use of this e-shop and his order, implies his agreement and acceptance of clauses of this regulation.
ARTONERY.com is at pains to give customer in our website reliable and proven product’s description and information. ARTONERY isn’t responsible for any changes setted by product’s makers, and isn’t responsible for any possibles errors in product’s descriptions.
All brand names and trademarks used in our website are the property of their respective holders and have been used only for information purposes.
We also inform that ARTONERY reserves right to: - realize big orders in individual – separate parts; - remove without any prior notice some products from our trade offer; - modify prices and available of products during the day and periodically; - add new products do our offer; - manage, change and cancel of promotion campaigns; - modify and update information in this regulations.

§ 12. Reservation of privacy
Contracting parties are obligate to keep secret information about rules of this contract. Customer undertakes to not transmit another persons any extra technical information obtained from ARTONERY (according with Polish law from 16.04.1993 about fight with unfair competition / protection against unfair competition).
